What is the difference between mutual consent and contested divorce?
In a mutual consent divorce, both spouses agree to separate and to the terms (maintenance, custody, property), making it faster, cheaper and far less painful. A contested divorce is filed by one spouse on specific grounds when there’s no agreement, and it takes longer. Where possible, we help convert a dispute into a fair mutual settlement.
Can I claim maintenance from my spouse?
Yes, a spouse (most often the wife, and in some cases the husband) and children can claim maintenance for their support. Interim maintenance can be granted during the case itself, and the amount depends on the paying spouse’s income and the claimant’s needs. We help you claim a fair amount or defend against an excessive claim.
How is child custody decided?
The single guiding principle is the welfare of the child, not the ‘rights’ of either parent. Courts consider the child’s age, needs, and the ability of each parent to provide a stable, caring environment; custody may go to one parent with visitation for the other. We build your case around the child’s genuine best interests.
I’m facing domestic violence โ what protection does the law give me?
The Protection of Women from Domestic Violence Act, 2005 gives you strong, fast remedies โ protection orders to stop the abuse, residence orders so you can’t be thrown out of the home, and monetary relief.
